General, Purchase, and Delivery Terms

The owner of the online store mylashy.com (hereinafter referred to as the Online Store) is Randevad OÜ (registration code 14902095) located at Harjumaa, Kiili vald, Kiili alevik, Toomkivi 5-5, Estonia, 75401 (hereinafter referred to as the Online Store or Seller).

Validity of the Sales Agreement, Product and Price Information

The sales terms apply when purchasing goods from the Online Store. The prices of products sold in the Online Store are indicated next to the products. The price is subject to a delivery fee. Information about the goods is provided directly at the product location in the Online Store. The buyer must pay for the goods via bank transfer using the bank link provided on the website. The cost of the goods is calculated and executed in euros.

Order Placement

To order goods, add the desired products to the shopping cart. Proceed to the shopping cart, confirm agreement to the General, Purchase, and Delivery Terms, and choose a suitable delivery option.

The buyer will be redirected to an information collection page, where they must enter their and/or their company’s details - address and contact information. The buyer must select a suitable payment method - bank links for Estonia, Finland, Latvia, Lithuania, Visa/Mastercard card payment, or PayPal.

After clicking "Pay," the buyer will be redirected to the payment page, where they can choose a payment method and complete the purchase.

Note: When paying with a bank link, be sure to click the “Return to Merchant” button on the bank’s page.

Payments are mediated by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment – bank link payments are processed in the secure environment of the respective bank and credit card payments in the secure environment of Maksekeskus AS. The Seller does not have access to the customer’s bank and credit card information. The agreement becomes effective from the receipt of the payment amount to the Online Store’s settlement account.

The Online Store is the data controller and transmits necessary personal data for payment processing to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to stock depletion or any other reason, the buyer will be notified as soon as possible and the paid amount (including delivery costs) will be refunded without delay, but no later than 14 days from the notice.

The agreement becomes effective from the receipt of the payment amount to the Online Store’s settlement account.

The Online Store has the right to withdraw from the sales contract and demand the return of the goods if the price of the goods in the Online Store has been significantly below the market price due to a mistake.

Rights and Obligations of Randevad OÜ

  • To provide services in accordance with legislation, service rules, and service descriptions.
  • To change service rules, service terms, and price lists, publishing information on the website.
  • Randevad OÜ is released from responsibility if the damage or loss of the shipment or part of it occurs after the package has been handed over to the courier.
  • Randevad OÜ is not responsible for the order if an incorrect or non-existent address or phone number has been provided; if the recipient no longer resides at the address; or if the phone number has changed, making it impossible to fulfill the order.

Delivery

Goods are delivered using parcel machines or courier services, and the Buyer selects their address during the order process.

Delivery is available within Estonia, Finland, Latvia, and Lithuania, with delivery to other countries upon agreement with the customer. Within Estonia, parcel services such as Itella Smartpost, DPD, Venipak, or Omniva are used. For other EU countries, delivery is arranged in agreement with the customer.

The buyer bears the shipping costs, and relevant pricing information is displayed when selecting the shipping method, unless delivery is free according to these terms.

Although the Seller strives to ensure that goods reach the buyer within 1-3 days from the contract’s commencement, please note that domestic shipments in Estonia may take 3-7 calendar days to reach the specified destination after the sales contract’s commencement.

The Seller will pack and dispatch the order after the receipt of payment. Orders are dispatched on business days (Monday to Friday). Orders paid for on a business day before 15:00 will be dispatched the same day. If the Seller cannot assemble the desired products, they will contact the customer to agree on product replacement or compensation.

Consumer’s Right of Withdrawal

The right to withdraw or exchange products purchased from the Online Store is valid for 14 calendar days, only for unused items. To return or exchange products, contact the Seller at info@mylashy.com.

The cost of return or exchange is borne by the buyer unless the Seller has sent a defective or incorrect product.

Right to Submit Complaints

If the Online Store breaches its obligations, the buyer has the right to use the legal remedies provided in the Law of Obligations, including the right to demand performance from the Online Store, refuse to fulfill their own obligation, claim damages, request a price reduction, claim interest for delayed performance, or withdraw from the contract.

The complaint must include the buyer’s name and contact details, the date of the complaint, the defect found in the product, the content of the claim, and proof of purchase.

The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days of receiving the complaint. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will replace the defective goods.

If replacement is not possible, the Online Store will refund all payments made by the buyer in connection with the sales contract.

The Seller is not responsible for any damage or consequences arising from incorrect data provided by the buyer during order fulfillment, including delivery delays due to circumstances beyond the Seller’s control.

The Seller is not responsible for defects that occur after the goods have been handed over to the buyer or for damages resulting from improper use of the goods.

Direct Marketing and Personal Data Processing

Personal customer data disclosed during the order placement and purchase process is treated as confidential. The Online Store uses the customer’s personal data (including name, phone number, address, email, bank details) only for processing the order and sending the goods to the customer. The Online Store transfers personal data to logistics service providers to deliver the goods.

Personal data entrusted to Randevad OÜ is treated confidentially and used only for the purposes specified at the time of data collection.

Randevad OÜ does not disclose customer personal data to third parties without customer consent.

Randevad OÜ is the data controller, and necessary personal data for payment processing is transmitted to the authorized processor Maksekeskus AS.

The Online Store sends newsletters and offers to the customer’s email address only if the customer has expressed a desire to receive them by entering their email address on the website or by checking the consent box for newsletters in the shopping cart. The customer can unsubscribe from email offers and newsletters at any time by informing the Seller via email or following the instructions provided in the offer email.

Dispute Resolution

If the buyer has complaints about the Online Store, they should be sent via email to info@mylashy.com or by phone at +372 56810512.

If the buyer and the Online Store cannot resolve the dispute through agreement, the buyer may contact the Consumer Disputes Committee operating at the Consumer Protection Board (http://tarbijakaitseamet.ee/et/tarbijavaidluste-komisjon) or go directly to court.

The review of complaints by the Consumer Disputes Committee is free of charge.

Additionally, complaints about e-commerce can be resolved using the EU online dispute resolution platform (ODR platform) at http://ec.europa.eu/odr.
